DUBAI, UAE: Horizons & Co has achieved a major victory for a company director, overturning a AED 17.6 million claim in the Dubai Courts through strategic litigation across three judicial tiers.
In a case led by Managing Partner Ali Al Zarooni, Head of Litigation, Refat Zidan, assisted by Legal Consultant Alaa Morad, and Senior Associate Eman Gad, the firm demonstrated that the second construction contract, which reflected a higher value, was not economically genuine and had been executed solely for financing purposes, as confirmed by contemporaneous correspondence with the insurer.
Court-appointed technical experts supported Horizons & Co’s analysis, confirming no additional works, quantities, or engineering justification for the contract price increase.
The Dubai Court of Cassation ultimately upheld the dismissal of the claim, reducing the director’s alleged liability from AED 17.6 million to zero in a final and irrevocable judgment.
